The Keeping Up With The Kardashian’s star and budding law student has filed a lawsuit against the makeup app iHandy for using a copyrighted image of her without obtaining permission.
The image in dispute is a 2017 bathroom selfie taken by the 38-year-old mum-of-four to promote her own KKW Beauty brand’s powder contour and highlight kits. Kardashian claims in the suit that the makeup app used the image of her to sell its own products.
The reality TV mogul is suing iHandy for $10m (AUD $14.4m) in damages, which includes image copyright licensing and any profits made from the use of the photo.
According to filed documents obtained by WWD, the 10 million dollar suit is said to be in response to iHandy’s “unauthorised use and fraudulent commercial exploitation of Kim Kardashian West’s photograph and worldwide instantly recognisable persona.”
Kim also claims iHandy manipulated and altered her appearance with digital makeup.
According to TMZ, the lawsuit claims that iHandy’s said they did not know the photo in question was of Kim, a claim that Kim’s legal team have cited as “absurd” due to her being “one of the most famous and recognisable women in the world.”
